1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of shop.orawater.in (the “Service”) operated by ORA Water. By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these Terms, our Privacy Policy, and all related policies referenced herein.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under the Indian Contract Act, 1872 to use the Service. By using the Service you represent that you meet these requirements.
3. Accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate, current, and complete registration information.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at info@orawater.in of any unauthorised use.
4. Orders, Pricing, and Availability
- All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
- An order is confirmed only when you receive an order confirmation email or in-app notification.
- We reserve the right to refuse, limit, or cancel orders at our discretion, including for stock, pricing errors, or suspected fraud.
- In the rare event of a pricing or product description error, we may cancel the order and issue a full refund.
5. Payments
Payments are processed through Razorpay or other authorised payment partners. We do not store complete payment instrument details on our servers. By making a payment you also agree to the terms of the relevant payment partner.
6. Delivery, Returns, and Refunds
Delivery, returns, and refunds are governed by our Shipping Policy, Return Policy, and Refund Policy, which form part of these Terms.
7. B2B Customers
Customers who register as “business” (B2B) may be eligible for wholesale pricing, credit terms, GST invoicing, and bulk fulfilment, subject to verification. Additional commercial terms may apply and will be confirmed in writing.
8. Subscriptions
Recurring subscriptions auto-renew at the cadence selected at checkout until paused or cancelled from My Subscriptions. You may modify, skip, or cancel future deliveries at any time before the next scheduled order is dispatched.
9. Loyalty & Referrals
Loyalty points and referral rewards are issued at our discretion under the program rules visible on My Rewards. Points have no cash value, are non-transferable, and may be modified or withdrawn with notice. We may reverse points earned through fraudulent or abusive activity.
10. Acceptable Use
You agree not to:
- Use the Service for any unlawful or fraudulent purpose.
- Resell our products outside agreed commercial terms.
- Interfere with the Service, attempt unauthorised access, or scrape data.
- Upload or transmit malware, viruses, or harmful code.
- Impersonate any person or misrepresent your affiliation with any entity.
11. Intellectual Property
All content on the Service — including logos, trademarks, product images, copy, illustrations, and software — is owned by or licensed to ORA Water and is protected under applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
12. User-Generated Content
By submitting reviews, ratings, or other content, you grant ORA Water a non-exclusive, royalty-free, worldwide licence to use, display, and adapt such content for the operation and marketing of the Service. You represent that the content is yours and does not infringe any third-party rights.
13. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation of the Service.
14. Limitation of Liability
To the maximum extent permitted by law, ORA Water and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the Service. Our aggregate liability for any claim shall not exceed the amount paid by you for the order giving rise to the claim.
15. Indemnification
You agree to indemnify and hold harmless ORA Water and its officers, directors, employees, and agents from any claim, loss, liability, or expense (including legal fees) arising from your breach of these Terms or misuse of the Service.
16. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms or for any other reason at our discretion. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall do so.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with the Service shall be subject to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat.
18. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the website or by email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
